The Specialized Inter-District Economic Court of Astana examined a lawsuit filed by a joint-stock company against a limited liability partnership. The large enterprise accused the entrepreneur of failing to fulfill their obligations in good faith.

According to the case materials, a contract was signed between the client, represented by a joint-stock company, and the contractor, which was a limited liability partnership, for the installation of software in the field of accounting. The client paid for the work, but during the program's inspection, he was dissatisfied with the specialists' performance and filed a lawsuit against the entrepreneur for 16.2 million tenge and a penalty of 503 thousand tenge.

The dispute between the businessmen was resolved in court.

In order to establish the fact of compliance with the technical specifications, the court involved an expert, whose conclusion indicated that the work performed under the contract met the requirements of the technical specifications. The court rejected the joint-stock company's claim against the limited liability partnership. Additionally, the court ordered the plaintiff to pay the defendant's representative fees amounting to 1.5 million tenge," the court's press service stated.

The decision has entered into legal force.

It was previously reported that a Kazakhstani citizen appealed to the Constitutional Court regarding the compliance of subparagraph 7 of paragraph 2 of article 144 and subparagraph 4 of paragraph 1 of article 170 of the Law "On Enforcement Proceedings and the Status of Court Executors" with the Constitution.
