The specialized interdistrict economic court of the Zhambyl region received a lawsuit from the American company New Balance, based in Massachusetts, against individual entrepreneur B. for the unlawful use of the company's trademark, as reported by Tengrinews.kz.
The company purchased its own product from the entrepreneur through an online marketplace, discovered the illegal use of its trademark, and subsequently filed a lawsuit.
"The plaintiff holds exclusive rights to the trademark NEW BALANCE. During the online purchase, the plaintiff learned that the defendant was using the trademark without permission in their online store on the Kaspi.kz application," the court's statement reads.
The plaintiff provided the court with a fiscal receipt, photos, and a video recording of the purchase, thereby confirming the fact that the defendant was selling counterfeit goods.
The court took measures to mediate between the parties, after which they reached a settlement agreement.
"Under the terms of the agreement, the defendant acknowledges the claim in the amount of 100,000 tenge: comprising a compensation of 73,000 tenge and 27,000 tenge for the costs of documenting the infringement. Additionally, the defendant will not use the plaintiff's trademarks, as confirmed by a signed guarantee letter," the court's press service reported.
The plaintiff waived their claims regarding the remaining amount, specifically the compensation sum of 296,000 tenge.
The ruling has come into legal force.
New Balance is a manufacturer of athletic apparel based in Boston, Massachusetts, USA.
