Citizen A. was charged with fraud, committed repeatedly (Article 190, Part 3, Clause 4 of the Criminal Code). The court's statement clarifies that the article prescribes a punishment ranging from 3 to 7 years of restriction or deprivation of liberty, with or without confiscation of property, as well as a ban on holding certain positions for up to 6 years.
According to the case materials, A. defrauded 10 people by promising to sell them Dubai chocolate and receiving money for it. In total, the amount involved was 301,020 tenge. However, the product was never delivered.
Witness testimonies from the victims, bank transfers, and case materials confirmed the defendant's guilt. The prosecution requested a sentence of 3 years and 6 months of restricted freedom for the man. The defense, on the other hand, insisted on a penalty that did not involve imprisonment.
