Time conversion in Kazakhstan: the court has made a decision.

The Astana city court has reviewed a case filed by citizen A against the government, seeking to declare the decree "On the Procedure for Time Calculation in the Territory of the Republic of Kazakhstan" and decree No. 20 from January 19, 2024, regarding its amendments, as unlawful and to annul them, according to Tengrinews.kz citing the court's press service.

The court of Astana has examined the case filed by citizen A. against the government, seeking to recognize as illegal and annul the decree "On the Calculation of Time in the Territory of the Republic of Kazakhstan" and the decree No. 20 dated January 19, 2024, which introduced amendments to it, Tengrinews.kz reports, citing the court's press service.

Previously, the inter-district civil court denied the claim.

The plaintiff argued that the shift in the time zone does not align with astronomical time, that the defendant lacks the authority to make such decisions, and that more than half of the text of the regulatory legal act (NLA) has changed, leading to the issuance of a new NLA.

According to the court's statement, under the law "On Ensuring the Unity of Measurements," the development of key directions for a unified state policy in the field of ensuring the unity of measurements falls within the government's competence. The government has established a consultative and advisory body - an interdepartmental commission on time and standard frequencies. One of its functions is to submit proposals to the government regarding the establishment and modification of the procedure for calculating time in the country.

"The appeal court concurred with the first instance court's conclusions that the adoption of the contested decrees was carried out by the government within the powers provided by Article 69 of the Constitution. Moreover, since more than 24 years have passed since the adoption of the decree on November 23, 2000, the court rightly applied the general three-year statute of limitations. The argument regarding the alteration of more than half of the text of the NLA was not substantiated and cannot serve as a basis for declaring the government decree illegal, as the procedure for its issuance by the defendant was not violated. The first instance court's decision was left unchanged. The judicial acts have entered into legal force," - the Astana court's press service informed.

Earlier, a resident of Ust-Kamenogorsk, Serikzhan Akhmetzhanov, filed a lawsuit in the civil court of Astana against the government of Kazakhstan, demanding to recognize the time change decree as illegal and annul it.
