The Ministry of Trade is not authorized to take measures for the liquidation of the Kazakhstani company that has come under sanctions. This was commented on today during a briefing following the government meeting by the Minister of Trade and Integration, Arman Shakkaliev, as reported by the correspondent of the Kapital.kz business information center.
“This is a company that was already listed among our other trading partners. Regarding its liquidation, there is information, including from the State Revenue Committee, that this company is not operational. As for its liquidation, this issue must be addressed within the legal framework. Either the owner or the founder initiates it, or it occurs forcibly due to legal violations at the request of authorized bodies. In our case, if there is a violation of tax or customs legislation, the fiscal authorities will certainly raise the issue of forced liquidation if the owner does not make such a decision themselves. Therefore, today this company is inactive, but it is not liquidated; its legal status remains,” he noted in response to journalists' questions.
The minister emphasized that Kazakhstan always adheres to its obligations regarding international export control.
“As for unilateral sanctions, we do not impose any sanctions against Russia as a trading partner; hence, this question may not be entirely appropriate from a legal standpoint. If the owner decides to liquidate, it will be liquidated; if it violates legislation, it will also be liquidated. Otherwise, we should uphold the rule of law. Concerning goods, monitoring, and so on, we have all of that in place. We are conducting relevant negotiations with our colleagues. We have a focal point that interacts on a permanent basis. From our side, we are not authorized to take any measures for the forced liquidation of economic entities,” the Minister of Trade and Integration emphasized.
The limited liability partnership, established in March 2022, is a small enterprise registered for the trade of electronic and telecommunications equipment. Over the past three years, the company's tax contributions have exceeded 434 million tenge.
